I propose to publish, at an early day, my book on the New Practice. It will contain the Code of Civil Procedure, and under each section thereof, will indicate its origin if the same be taken from the old law or from the Code of any other State. It will also state in what other States the law is the same, and where such sections may be found in the books of such State. If upon any section there have been decisions made by our own Supreme Court, or by that of any other State the same will be given in substance, immediately thereunder. Comments will also be made upon the leading sctions, with a view to illustrate the remaining applicability of the old law of Pleading, and in the endeavor of furnishing the legal logic of the present system. Simple forms of Pleading, such as may suggest the substance required by the new Code, will also be given. I hope that my relation to the Code of Civil Procedure, as its framer, and my exhaustive collection of works on Practice, will enable me to offer a book useful to my legal brethren. The book will be issued in the spring - will contain between 600 and 700 pages. The paper, printing and binding, shall equal that of the "Revision of 1860," and it will be delivered at any Post Office within the State for $5,00. The book will be sold by me alone, and as I cannot tell how may copies I may safely publise until I can form some estimate of the number I can sell, I beg each person who desires a copy, to append his name and address to this circular, and at once return the same to me. I hope I may do better than they did, and they went to work under The Cry of "Reform." They had four sessions of the Legislature. [Laughter] , Will you let e tell you what this return Legislature and The previous legislature, under McClurg, cost the State #342,266.36. This last Democratic Legislature cost the State, in the [illegible] expenses of that body, $461,594.19, which is in excess of expense by that body of $120,000. The people pay rather dear for reform, dont they? [Laughter.] They charge the Republican party with being a band of thieves. They say that we steal every thing we lay our hands on. Well, I con't know but that they could afford to let us steal a large amount, and still that would be better than they have ever done. Why, sir, the Republicans took the State of Missouri in 1865 with a public defb of thirty-five millions and a half. In 1867 they reduced it to twenty-nine millions and a half; in 1868 to twenty-four and three quarter millions; in 1869 to eighteen millions and a half; in 1870 it stood eighteen millions and a half; in 1871, $17,869,000. And in that condition we turned the State over to the Gratz Brown Legislature. What now is the public debt of the State? $18,352,000, with a maturing indebtedness of a million more. And not a provision made for the payment of a dollar of it! I am not surprised, however, at the conduct of the last Legislature, because it commenced its work with the special work of nominating and ELECTING FRANK BLAIR over me for the United States Senate. What could you expect of such a body as they? [Laughter and applause.] I was like the prophet when he gazed upon the face of Haziel. The moment that I looked upon the face of tha Legislature I contemplated the miseries of my State, and I am not surprised at what they have brought upon us. But there is another thing to which I wish to call the attention of the people of St. Louis. I am astounded myself at what I have found in this canvass. Gentlemen, I have been over this State, from the one end of it to the other. I stand here tonight to make good what I say, and it is this: that the lands - the farming lands of Missouri - have become reduced in value during the last to years from twenty five to 100 per cent. In some counties I find lands reduced 100 per cent in value. In others, on account of local causes, not so much. But universally you find this reduction in the real estate of the State. There is another fact alluded to by my friend, Maj Pearce, which is as true as gospel, and that is that no immigration is coming into the State - none, whatever. Now, sir, there is something the matter. There is a cause for everything, and explain this the best way you can and tell me WHAT IS THE CAUSE of this suspension of immigration? Why is it that nobody is coming and settling here? Why is it that Chilicothe, in Macon City, in other towns in the State, young and prosperous towns two years ago, there are now a large number of store-[illegible] [illegible]? Why is it that dwelling-houses cannot be rented in these towns? Why, is it that town lots are depreciating in value? Why, gentlemen, I tell you that we are absolutely losing population, and it won't do to refer one to the increased registration. I know what produces the increased registration. I know that it abroad; the nation is in a better condition than it ever was; we have a better currency to day for the artisan, the mechanic, the merchant, the farmer, the banker, than we ever had since the oldest man came into existence. Don't you know it? What nation has a better currency than ours? It is true that the greenback was worth sixty-nine cents when Grant became President - to seventy one or seventy-two, along there. What is it now worth? Ninety-two, and during the next four years of Grant's administration the greenback will be worth par, [specie?] payment will be resumed and the country on the high road to prosperity. [Applause.] when Grant became President your six per cent bonds were worth seventy-nine and one-half, they are now worth more than par, a 5 per cent is worth par, and, in fact, Mr. Boutwell was unable to fund, as I have already said, two hundred and five millions of six per cents into fives, because the five per cent bonds of the United States were worth par. Now, during the next administration of the government, we will be enabled, under the wise administration of Mr. Boutwell - we will be enabled, I have no doubt, to float four per cent bonds at par, and thereby REDUCE OUR RATE OF INTEREST from six to four, possible to three and one half. [Applause.] But I see it stated in one of the papers to day that I stated at Hannibal that I wanted Grant not only for the next four years, but for eight years longer. I said no such thing. I said that if my Democratic friends could do no better than nominate grandmother Greeley, that I would take Grant for the next forty years in preference to him [Applause.] The Missouri Republican is mistaken in my desire to have Grant more than four years, because at the end of that time I intend to put in for the office myself. [Great laughter and applause] I don't blame you for cheering, my fellow-citizens. [Renewed laughter.] The truth of the matter is, about two terms - and I will be able to serve two terms as Governor, you know - two terms as Governor of the State of Missouri will demonstrate not only to my Republican friends, but to my Democratic friends in Missouri, and not only to Missourians, but to the PEOPLE AT LARGE throughout this happy and prosperous country of ours, that I would make the best President of the United States. [Laughter and applause.] Nobody else mentions this fact, and I thought I might as well name it myself. [Applause.] But, fellow citizens, some of my friends are desperately uneasy because they say I am in a conspiracy to force Gen. Grant upon the people the next term. Well, sir, I am in no conspiracy. Now, I do think that some papers - I will not name them, I hate to allude to the Missouri Republican because I like the editors of that paper. [Great laughter.] I never shall forget their kindness to me when I was a Union candidate for Congress in [year], running on the Douglas ticket; they were very kind to me and I feel indebted to them, and I RECOGNIZE THEM AS GENTLEMEN in the largest and best sense, but they have not treated me right in this canvass. It is true they say that I am a clever, upright, good fellow. Well, I knew that before and so did you. [Laughter.] I have caused the slips of my speech to be sent to that office, and they will not publish them. But yet they keep publishing what they say are my speeches, and they will not take the text as published by my authority. Now that is not right. They may think it right from their stand- abandoned me; and now, on the day when [illegible] their suffrage, the honest Irishman and the honest German will be found with me on next Tuesday. [Applause] But what is the use of my standing and talking here any longer? The truth of the matter is, that fate has already decreed the election. It is a fixed fact. The agony is over, the baby is born, and next Tuesday evening his name will be Henderson. [Great laughter and applause.] <hr /> hundred and ninety), which is thirty-seven thousand four hundred and thirty, which will make the vote as follows: Henderson, one hundred and forty-five thousand one hundred and one; Woodson, one hundred and thirty-four thousand eight hundred and ninety-nine - [applause] - making my majority ten thousand two hundred and two. [Applause and laughter.] I am [illegible] Woodson's friends desire it, I will call it then, for short, ten thousand two hundred, Gen. Grant's vote will be larger than that. He will get the same vote that I do - ten thousand two hundred majority - and in addition to that there are at least fifty Democrats in each of the counties of the State) there being one hundred and fourteen counties) that will vote for O'Conor, who will also vote for Woodson. That will make a difference of five thousand seven hundred who will vote for Grant, which will make Grant's majority in the State sixteen thousand five hundred and sixty. [Applause.] Now I am very well aware that somebody will tell you to-morrow morning in the papers that I am mistaken. [Laughter.] There are some gentlemen laughing over there who do not believe it. [Renewed laughter.] I recollect when the NORTH CAROLINA ELECTION was held that for three or four days after the election was over I was taunted from one side of the streets here to another, and my Democratic friends all took occasion to get drunk in the excess of their joy. After four or five days elapsed the news came that instead of ten thousand for Merriman the State had gone for Caldwell. The laugh was turned, but I could not get back the drunk of my fellow Democrats. [Laughter and applause.] Now, I advise you, my fellow Democrats, if you desire to get drunk on Woodson's election, you get drink before the 5th day of November. [Laughter.] What is the use of electing Woodson? [Laughter.] I really don't know where the man has gone. I invited him to canvass the State with me, and he refused to do it, saying he had caught a bad cold, was quite hoarse, got caught out in a shower of rain. Do you want a man as Governor of the great State of Missouri who does not know enough to come in out of the wet? He stated to me that he got caught in the shower up in Cameron. I was up in that neighborhood of Cameron a day or two afterward; I INQUIRED ABOUT THAT SHOWER. I Had not seen any showers of rain, and they told me that the day that Woodson was there was the clearest day that had perhaps passed over Cameron in the last eighteen years. [Laughter.] Now there is no danger of our Democratic friends electing a man who has not sense enough to come in out of the wet on a clear day. [Laughter.] Why, you don't intend to do any such thing: you don't dream of any such thing. I have not heard of Woodson for some time. He passed in from the North Missouri Railroad, up about Kirksville somewhere, to a region of country in which I have been unable to hear from him, and I believe that Woodson has been canvassing for the last two weeks in Iowa. [Laughter.] HE WILL RUN BETTER IN IOWA, a great deal better than in Missouri. [Laughter and applause.] What in the world the man is going through Putnam and Mercer and Harrison and those counties for, I cannot imagine, for I understand there is nobody for him at all there; but the excuse, or reason rather is, in my judgment, to get out of the way, hide himself. He went into a hole up there somewhere, and drew the hole in after him. [Laughter.] Well, Woodson is a very clever man. I have said nothing against him; not a word during all the campaign, and I do not intend to say anything. [Laughter.] He is a gentleman, a man of ability enough to canvass with anybody. It was not that he feared me in debate, it was simply that he had no cause to advocate before the people that he did not canvass with me. Why, this canvass has demonstrated one thing, my fellow citizens, that if the election had come off three months ago we would have been in danger of defeat. But they can't stand a canvass - they can't stand argument. The whole thing is without a bottom, and the very moment you begin to discuss the principles of the two parties, of course the Democracy go to the wall. [Applause.] Woodson is just sharp enough to know that fact; he was sharp enough to know it, and so he has kept out of the way. Now, he is a gentlemanly fellow, and if elected Governor, would do the best he could - and that is devilish little. [Laughter and applause.] He can't do anything, nobody can do anything in Missouri, occupying Mr. Woodson's position. Why, go to the Missouri Republican of the 25th of last month (I don't quote Republican authority); go to the Missouri Republican on the first of that great sheet, and there find the condition of the finances of the great State of Missouri to-day. Do you know that there are THREE HUNDRED THOUSAND DOLLARS OF WARRANTS drawn by the Auditor upon the Treasurer of the State that are being hawked about form one end of the State to the other to-day, at from 75 to 80 cents to the dollar, without one cent in the treasury to pay them. That is the condition of affairs. That isn't all. Why, sir, there will be $530,000 of interest on our hands, due on the 1st day of January. Has any provision been made for the payment of that interest. Not one particle. That is not all. There is $250,000 of your bonds maturing within the next two or three months, and not one particle of provision made for the [redemption?] of it. Why, sir, here is upward of a million of dollars maturing within the next few months upon the State Treasury, and not one dollar to pay it. Well, sir, what was this Democratic Legislature that convened in the state two years ago doing? Are you aware that they held four sessions of that Legislature? Why, it was bad enough under Radical rule. Our friends have got into a very bad practice in this State. Instead of holding one session in two years, as required by the Constitution, they fell into the habit of holding two sessions, and you ought to elect me Governor to break up that bad Ross, who are now supporting him for the Presidency - that they were guilty of bribery. He said enough against me to determine me never to vote for him FOR ANY OFFICE ON EARTH, and I never will, never! [Applause.] Now, fellow citizens, don't you think it will be a great deal better for you, Democrats and Republicans, to take me as Governor of the State of Missouri? I needn't talk to you about Gen. Grant's election. You know as well as I do that out of the three hundred and sixty-six electoral votes to be cast this fall, Greeley will not and cannot get ex eeding eighty. [Applause.] That is a fixed fact. You all know that what I state is true. You may cipher s much as you please, you may make your calculations, and yet it results in the fact, that Gen. Grant will inevitably be your next President. [Applause.] Well, I don't know what you think about it, but I will tell you what I think about it. I think exactly as Greeley thought a short time ago. Many things grow contrary to our wishes at the time (that is not from Greeley, that is from me) [Laughter.] Many things may be contrary to our wishes at times which we exceedingly regret, but afterwards we come to believe with Pope in his celebrated lines when he says: "In spite of pride in erring reason's spite, One truth's confessed, whatever is, is right." Grant is to be your President, and that thing is most certainly right. [Applause.] I think as Greeley thought when Grant was first nominated. He knew Grant then as well as he now knows him, and he then said: "The election of Grant secures the ascendency of liberty, justice and peace; it is the Appomattox of our civil conflict: it assures us that ours shall be henceforth a land of equal rights and equal laws; it makes our recent history coherent and logical; it demonstrates that the discomfiture of the rebellion was no blunder, and no accident, but THE TRIUMPH OF PRINCIPLE and an added proof that God reigns in Heaven. [Applause.] He said, in 1867, we did profoundly honor and esteem him; that he has never uttered one syllable that sounded of exultation over the defeated rebels. In 1869 he said, "Gen. Grant is thoroughly a citizen to-day, as perfectly civilian in his habits as any man in this country. We think of no one in pubic station who represents more fully the idea of the American gentleman, unostentatious, unassuming, brave without ambition, forbearing, resolute in doing what he deems to be right, but never offensive in asserting himself. Gen. Grant is a man of the people, one in heart and feeling with the men who dig and plow and weave." What he then said is true to-day. [Applause.] Now, sir, just before Grant was nominated Mr. Greeley said, and said truthfully: "I saw, the other day, the suggestion that I would be the best Democratic candidate to run against Grant for President. I thought that the most absurd thing I ever heard or read." I think so, too. [Laughter.] "If the Democrats were called upon to decide between Grant and myself, I know that their regard for what they must call principle would induce NINE-TENTHS OF THEM to vote against me. Why, I am a decided enemy of that party, even its most respectable aspects." [Laughter]. And again he said, just a short time ago, "May it be written on my grave that I never was a follower of the Democracy, and lived and died in nothing its debtor." I do believe that the Democracy of Pennsylvania, Ohio and Indiana, and all the other States of the Union, will consent that the old man may not die its debtor. [Applause.] Why should not Grant be elected? Gentlemen, look at your foreign relations - peace with England, the Alabama claims paid off, a new principle of international law fixed in the law, in the code. Look at your internal policy; look at home. (I shall detain you not five minutes longer; you need to not be uneasy; five minutes is all.) Look at your internal policy: how is it? Are your taxes not reduced? Why, sir, $203,000,000 have been taken off the shoulders of the people since Grant became President, including the acts of 1868, the closing year of Johnson's administration, which took effect under Gen. Grant's administration. That is not all. Why, sir, the interest upon the $360,000,000 already paid under Grant's administration of the funded debt of the Union, including the $2,050,000 saved by funding $205,000,000 of your six per cents, into fives, would make $23,000,000 in the rise annually, and that put into a sinking fund would absolutely, in thirty years, pay off the public debt of the nation. That is not all. Mr. Boutwell, in a speech here the other day, said, and it is true, that there has been SIX HUNDRED MILLIONS of revenue collected at the ports under tariff acts, and not one single dollar of that $600,000,000 lost by defaulting public officers. There have been some few defalcations in the internal revenue. A larger portion of them were the appointees of Johnson's administration, not exceeding $100,000 of defaulation under the appointees of Gen. Grant. Therefore, gentlemen, you have had really an economical administration of the government, one that has saved in expense of collecting the revenue (it does not cost now more than half it did to collect the revenue under Mr. Buchanan) -. Not only that, but the current expenses of the government have been reduced $99,000,000 from the last of Mr. Johnson's administration. [Applause.] Now why, under these circumstances, with peace abroad, peace about to be established at home, and with a reduction of taxation; the tariff itself, my Democratic friends, since Grant was President, has been reduced $64,000,000, and the balance of the $203,000,000 of the internal revenue. Why, look at that. Why, look at your internal revenue laws; they are about now to cease - will be under operation but a short time longer. But why talk about these things? Whether you like it or not, you are BOUND TO HAVE GRANT, and it is the best thing for you, it is the best for me, it is the best for the whole country. [Applause.] American citizenship is honored the certificates, whether procured by fraud, violence or duress. It was insisted that if a SQUAD OF SOLDIERS broke in upon the Electoral College of one of the States, and compelled one of the Electors to sign a certificate against his own judgment, and in defiance of the will of the people expressed at the polls, yet this constrained and fraudulent vote must be counted. It being sealed and sent to the Senate, it was therefore conclusive. Well now, gentlemen, this is worse than absurdity itself. It was a treasonable surrender of the rights and liberties of the people to a mob. [Now?] my Democratic friends; you don't credit this thing? Suppose, if Gen. Grant be the dangerous, usurping military dictator you are [aug?] to believe, how easy it would be for him to [issue?] certificates enough to elect himself. Now [illegible] he may be of improper [illegible] his power, some bad man in the future may attempt it, and where is our protection, except in Congress? The Constitution was designed to establish this very check against the usurpation of a bad President, and also against the violent and revolutionary proceedings of the States. Hence, in 1865, Republicans and Democrats, among the latter Reverdy Johnson, of Maryland; Buckalew, of Pennsylvania, candidate for Governor; Hendricks, of Indiana, the recent candidate for Governor; Garrett Davis and Gov. Powell, of Kentucky, joined in their votes to exclude from the count three States which had voted for Mr. Lincoln. Again, in 1869, CONGRESS RE-ASSERTED THE POWER to go behind certificates, and declare that the vote of this same State, Georgia, should not be permitted to influence the result of the election. Now, my fellow-citizens, the right of the negro to vote is embodied in the Constitution, and both parties in their platforms re-asserted that right. This right is a sacred one. You cannot violate it in the case of one man, however humble he may be, without offending the Constitution itself, and without striking a most dangerous blow at the liberties of your country. You cannot cover up and conceal the wound by the mantle of State rights. It is the same mantle you brought to recover secession - the denial of the right to sue in your courts, to testify as witnesses, or to exercise any right which bigotry and prejudice might deny. If you bring this mantle again to cover up violence and election frauds, and force on the people a man against their will, I repeat what is said at Joplin, and I repeat it in all its force, that Congress must refuse to sanction the outrage; and if rebellion ensue, the old armies are ready to maintain the Constitution just as it is, with freedom and citizenship and enfranchisement. [Great applause.] Now if this be treason, my Democratic friends, make the most of it. It is the same Constitution of the country. It is right, and I tell them that it is best for us to tell them what will be the consequences of their fraud and rascality. [Applause.] Why, sir, a man of 1861 dare not say that he was in favor of coesciition. Why? Why these fellows FRIGHTENED THE PEOPLE TO DEATH, and said that he was a bad man, and in favor of dividing the Union, while they themselves were plotting treason every day. Now I tell them that I am not to be intimidated, and any honest Democrat will say amen; any honest man will come and say that whenever we sit by and suffer fraudulent votes and revolutionary proceedings to carry States, and if we must count the vote,s whether in favor of Grand or Greeley, our liberties a e gone. I say to them that their purposes are, if they could have carried Pennsylvania and Ohio for the Greeley ticket, their purpose was to carry the entire South by fraud and violence, and if they had succeeded they intended to go to Congress and declare that we could not go behind the fraudulent certificates. I told them that Congress would go behind them, and if they wanted to rebel against it, as I said before, they might put their forces under THAT GALLANT COMMANDER, Horace Greeley, and we would put ours under Grant, Sherman and Sheridan. [Great applause.] Now I am not afraid of being beaten for Governor upon this idea. [Laughter.] Some Democrats become frightened, and newspapers told tend thousand lies, and it frightened Democrats away from me. I tell them Democrats in Missouri will vote for me, not by thousand, but by tens of thousand. [Applause.] I tell them that I shall not lose a Republican vote in the State, not one. Why, sir, there are not over five hundred of the old Liberals left. [Applause.] I am as liberal as any man need be. I was a Liberal in [1870?] I am as liberal to-day. What in the name of sense need a man to use any more liberality than I have exercised toward all men. ["Hear," "hear."] Nobody needs it. Nobody should have it. I am as liberal as the most liberal could be. I have gone for the SUFFRAGE OF EVERYBODY. I am at heart a genuine old-fashioned Democrat, in favor of - I don't mean this modern species [laughter] - I am an old Jeffersonian Democrat, believing in my whole heart of hearts in the right and the ability of the people to govern themselves. [Applause.] And when I say the people, I do not mean the white people, but I mean white and black. [Applause.] I mean that every man who bears the burden of citizenship should in justice enjoy its privileges. [Applause.] I do not mean the white or black native races of our country; but I mean the Irishmen, and the Germans, and the Italians, and the Frenchmen, and all others [that?] come to seek asylum in our country, and subject to its laws, take the oath of allegiance and become good citizens. [Applause.] I know no difference, and I tell my Democratic friends to-night, to put them on their guard, that on next Tuesday I shall receive very nearly the entire Irish vote of the State of Missouri. M.---The latest returns from Maryland show that the Unionists elected 3 out of 5 Congressmen. The Republican majority in the State is estimated at 5,000. Philadelphia, Nov. 10.--The Press estimates the Union majority in Pennsylvania on the home vote at 10,000. The Age considers the result doubtful on the home vote. The result in New Jersey is about 7,500 majority for McClellan. Two Republican and three Democratic Congressmen are elected. The Albany Journal claims New York by at least 5,000 Union majority. The Argus claims the State by 1,500 Democratic majority. The New York Times puts the Union majority at 8,000, the Tribune at 7,000, and the Herald at 5,000, The World claims a McClellan majority of 2,000. Delaware has gone for McClellan, though but little has been heard from the West in consequence of the storm. The Herald states an exchange of 10,000 prisoners has been agreed to, and a first instalment of rebels left for the Savannah river yesterday. The rebel papers contain another letter from Congressman Boyce, in which he explains that his object is to break down the wall of fire which separates the South from the influence of peace North, and expresses the faith of the Lincoln policy is repudiated in the election; this could be secured. The story published that Atlanta had been burned, and that Sherman was marching directly on Charleston, S. C. is discredited in military circles, but the New York Times Washington special has a long dispatch this morning stating that Sherman was probably on his way to Savannah, Ga. It was rumored that McClellan sent in his resignation as Major General on Tuesday night, but has since been denied. Brooks was defeated in the 8th Congressional New York District. The World claims his election. It is reported that the pirate Tallahasse has been sunk or captured. Amboy November 10.--About four o'clock this A. M. a fire broke out in the wooden building owned by Edward Arnold, on East Avenue occupied by A. Jackson, dry goods and groceries, and spread with fearful rapidity, entirely consuming in its wake the boot, shoe, and leather store of Phillip Goldman adjoining, and the clothing store of S. Goldman; also, the brick store of Messrs. Carson & Pierce, jobbers and retail dealers in dry goods, and the large hardware of Messrs. Perley & Blackstone. Considerable damage was done to the new brick block of Badger & Bro., which was nearly completed. A heavy west wind was blowing, and it was at one time greatly feared that the entire city would be destroyed. Loss from sixty to seventy thousand dollars, partly insured. Amuerstbug C. Large invoices of stores will be sent there from New York, Baltimore and Washington, and the force of relief agents increased according to the largely augmented demand for their services. The Herald states an exchange of 10,000 prisoners has been agreed to, and a first instalment of rebels left for the Savannah river yesterday. The rebel papers contain another letter from Congressman Boyce, in which he explains that his object is to break down the wall of fire which separates the South from the influence of peace North, and expresses the faith of the Lincoln policy is repudiated in the election; this could be secured.
