Will Gov. Yates hear the statement of B. M. Cox Esp. Mr. Cox is known to me to be a true loyal man. - the Gov. will also please examine a slip cut from the Alton Telegraph relating to J. M. White, which, if true, and I learn from other sources that it is, right to dispose of him very effectually.

D. L. Phillips

J. M. White - REMARKABLE CONVERSIONS. - On the 1st of June, 1864 J. M. White authorized us to place his name in our column as a candidate for Prosecuting Attorney of the 24th Judicial Circuit, subject to the Union Belleville Convention. He was a good Republican, Abolitionist, perhaps.

About the middle of June, he made a speech in favor of J. C. Fremont in Belleville. A clear case of radical change of heart, perhaps.

On the 23d of June he announced himself as an independent candidate for Prosecuting Attorney of the 24th Judicial Circuit, in the secesh Alton Democrat. Here he turns Seceder, sure.

Some time in the month of July, perhaps, he made application, we are informed, to a commission in negro regiment. Here he gives evidence of returning to his first love.

He seems to have rested in a blissful state of peace with himself and the people of the world, until last Saturday evening, when the great apostle of Peace, Dick Richardson, preached "McClellan, and him justified," in City Hall. The doors of the McClellan church being open at the close of the performance, J. M. White, went forward and declared himself a believer in the McClellan gospel of peace as set forth in Chicago Platform, and that henceforth, like the wandering dove, he should rest in the peaceful bosom of the McClellan wind of the Democracy. Peace to his sorrows.

Another Company. - The undersigned respectfully solicits the attention of the citizens of Alton and vicinity to the raising of his company of infantry, which he wishes to join the Alton regiment of Prison Guards. There is now but a few days for enlistments, ere the draft will have swept through our midst and taken its desired number of men. Let every heart beat in unison, and at once fill up this company, there are only about forty men wanting to make it a full company.

B. M. COX

Dr. Sir

I desire to Call your attention to the Case of Wm P. Miller Co. D. 104th. Regt. Ill. Inftry.

He is at Camp Douglass on the Charge of desertion His Case will probably be reported to Col. Oakes tomorrow, He has been in hospital since Aug. 16th, a Physician's Certificate, shows him to have been unable to report for duty, & to be still suffering from ill health, unfit for service, and unable to rejoin his regiment.

There seems to be some feeling against him on the part of one Hutton 3d Serg't. of the Co. who was promoted to his place after the removal of Miller, who was formerly third sergt. Hutton has made up a statement of material & immaterial matters, which he charges upon Miller the descriptive roll charges desertion only Which is explained I think by the certificate of the Physician who attended him, soon as able he reported here & went into the Hospital, where he was, when his descriptive roll came, having once through his Physician reported to Adj. Gen. Fuller who directed him to report at Chicago. Millers health will not permit him to travel

(over)

I know not what else to do. He is so fare from his Reg, and his health, and spirits so reduiced I apply to you our Gov, and the soldiers noble friend, knowing, that you, in your kindness, will do all in your power, for one of your soldiers.

surved under Col Wilder untill they were put in to a Hvy Corps of Cav, I can say with ashureance, that he did his duty as a man and a soldier, as long as his health permited. But last March it entirely failed. and the last of Apr. he was sent back to Chattanooga, where he has remained in the Hos, untill about too months since. He has been sent from one Hospital to another, and is now at Mound City.

His health is growing worse all the time and the Drs tell him he can not get well, unless he can be kept very quiet, and have the best of cair.

Oh, will you send me his discharge that I may go at once, and bring him home. He has already been in the Hos, - five months. Pardon me, if, in my anxiety, I have writen an unformal, letter to your exelency

As I came by Centralia & Du Quoin I found that both places had Extensively advertised Genl Logon & Genl Oglesby for the 12th (visit?) & neither would give up - So that both meetings will go on. I suggested that one of them might go to each - & that I would attend with one & you might be induced to attend with the other - this would satisfy them, they will have large meetings at both - can you come if so take your choice of places - & of Generals - I am content with Either

Sir Your very kind letter I found on my table this P M on arriving home for which I am thankful & grateful.

He told them One could go one place & the other to the other. He would go to one & the Govr might be induced to go to the other. Wants to Know if he will

The failure, or rather I hope, temporary suspension of the W.M & F Ins. I am asking $12,000 for the whole or $6,000 for one half. Please let me hear from you at the earliest convenience. Respectfully yours

                    <text>
Olney Ills. Oct. 1st 1864

To His Excellency

Gov. Yates.

Dear Sir,

Parden me for calling your attention to the recent murder, at Quincy in this State, of my Son Lewis Wright---a Soldier---by one Oliver F. Cornman who called himself a "Missouri bushwhacker," in a manner that I think calls for his arrest, trial and punishment by a military court.

Said Lewis Wright was a private in Com "C." 63rd Ills. Vol. but on account of sickness in the Summer of 1863, was transfered to the Vet Reserve Corpse, and in April last was sent to Capt. Asbury Provost Marshal at Quincy Ills. as one of his guards.

The evidence in the case is about as follows, (as I saw the written statements of three witnesses, in the hands of Capt. Asbury)

On the evening of the 8th of Sept./64, while Wright was standing on the sidewalk near the Provost Marshal's office in Quincy, engaged in a friendly and social conversation with two citizens of his acquaintance, they were rudely accosted by one of two persons

(2)

who came up and spoke insultingly to them, but on receiving no answer, walked a few steps past, halted, came back and this man Cornman challenged them for a fight, addressing himself to Wright, and said he would bet him One hundred dollars against fifty that he could whip him, saying something about Soldiers at the same time, to which Wright replied that if he was a Soldier, he was a civil man and would have no disturbence with a citizen, that he would "not fight a citizen". Cornman urged for a fight and became more boisterous. Wright, in a mild manner, repeated his former remarks, to which Cornman said he was "no citizen." Wright asked him what he was? if he was neither citizen nor soldier? Cornman said "I am a Missouri bushwhacker." The two took hold of each other. Wright struck Cornman with his fist and knocked him down. Cornman jumped up came at him swearing and threatening. Wright knocked him down again in like manner, and commenced striking him in the face. The other fellow who came up with Cornman caught Wright about the shoulders and threw him back some distance. Wright fell to his hands & knees.

(3)

and as he was getting up Cornman commenced shooting at him with a revolver, discharged four shots in quick succession. and wheeled and runn. Wright fell at the first shot & commenced getting up---fell again at the second shot & made no effort to get up. Two of the shots were fatal,---one taking effect in the bowels, and the other in the lungs---a third a small flesh wound.

Wright lingered about 46 hours and died conscious of having given no offence.

Cornman, though a stranger to Wright and unknown to him or to those who were with him at the time of the shooting---turned up to be a citizen of Quincy, and was arrested and is jail on a formal charge of murder to await his trial before the Circuit Court. I do not like to impugn the motives of others, but I have little doubt the matter will be baffled in the Circuit Court---put off, and finally the criminal go with but little or no punishment, whereas a military Court is the proper one to try "bushwhackers," and where justice would be sure.

Permit me to say (although Lewis was my son) that I know, and I have it from his officers and fellow soldiers, that he was a faithful and brave soldier, that he was courtous an civil to all persons---That he sought the acquaint

ance of others for social and religious intercourse, and was loved and respected by all who knew him in the army.

I am your bedient Servant.

James Wright

Calls Govr's attention the murder of his son a soldier of the VRC who was doing duty at the Pro. Marshal's office in Quincy. Says that the murderer is awaiting trial at the civil court, & he thinks he should be tried by military Court Martial.

                <text>
Olney Ills. Oct.

                    <text>
Camp 43rd Regt Ills Inf. Vols.

Little Rock, Ark. Oct. 6th 64

Governor:

The undersigned Officers of this 43rd Regt Ills. Vols. most respectfully beg leave to represent to Your Excellency the following facts ,with the request that Your Excellency would take immediate steps, to secure us the ends which we wish to attain. According to the rules & regulations of the Muster-out of troops, the Hon. Veterans of our regiment would have to be mustered out by companies separately and successively as they were mustered in, in August and September 1861. Those of companies "A", "B", & "C" have accordingly been mustered out. The Mustering officer here contends that no company can be mustered out until after the expiration of the term from that date, where it had attained at least the minimum number of men; thus Companies "B" & "C" were not discharged until the 26th day of September, although these companies were mustered in almost a month previous to that time in 1861. Capt Pitcher of the regular Army mustered and accepted into the service of the U.S. eight companies of our regiment during the month of September 1861, although some of them had not at the time attained the minimum number of men and issued to each of the comdg officers a

copy of the Muster-in Role of their respective companies. These organizations have since continued to excist and be paid as such, fully officered to the present day, without the least objection ever being offered by the Government either through the Adjs General, who viewed the regular Muster Rolls, or it's Mustering and Disbursing Officers. Two more companies, "I" and "K" organized at Benton Barracks Mo and mustered-in, the former on the 8th and the latter on the 29th November had also not the requisite number of men, and never had since, but were nevertheless accepted as organizations and continued. On the 16th day of December the first 8 companies were again mustered and sworn by Lieut N. F. Swett, 13th U.S Inftry. This Officer promptly forwarded the Rolls of said Muster to Washington, which Captain Pitcher has evidently neglected to, for upon application being made by the regiment Comd'r for advice from the War Department when those Men belonging to companies, who never attained the Minimum, should be mustered out, as the case is not clearly defined in the general Mustering Regulations, answer was received here day before yesterday, that no more companies should be mustered out before the 16th of December 64,

as there was no record on File in the Adjt Genl's Office that any of the companies had been accepted previous to Lieut Swett's Muster on the 16th day of December 61. except Co "C" which company had previously been mustered by Capt Pitcher, and was entitled to be discharged Sept 5th 64. How that single roll came to the Adjt Genl's hands, and no other, is impossible for us to tell. At all rates the authority of Capt Pitcher's Muster is acknowledged and his signature on the roll retained by the company comdr's here, should be respected, and the men mustered out accordingly. The Adjt Genl. also confirms, that no company can be mustered out till after expiration of the term from the date where the same attained the Minimum Number. But the Government certainly does not want to thus formally press the men into it’s service. The Men swear on their Enlistment to serve Three Years, and after the faithfull performance of duty during this time they should be discharged. No one in this regiment will refuse nor grumble about serving a reasonable time beyond he term should excigencies demand it, and a good many now have thus already served over a month longer, but to be held, for mere sake of the want of a clearly defined rule in such a case as ours, some three

three months beyond the term, is decidedly unjust, and not carrying out the conditions of the mutual agreement between the soldier and the U.S. and we are certain this matter would immediately be attended to, if the facts are only brought to the Knowledge of the War Department. As however, before an answer can be received from Your Excellency, the space of time between this and the 16th day of December 64 will almost have transpired, we sincerely beg your Excellency, to secure for us at least this much as the War Department, that all the Men in the Regiment who have established prior to the 16th day of December 1861, will be discharged & mustered out at once on the same date in this Year, no matter whether the companies to which they belong were minimum companies at the respective time or not; so that the remaining portion of the regiment can be promptly consolidated and reorganized. We have the honor to be Your Excellency's obdt. servts.

We have the honor to be Your Excellency's obdt. servts.
